Empty Promises on Harassment & Excessive Overtime

Unless we Vote No, the proposed UPS contract guarantees five more years of harassment and excessive, forced overtime. Here’s why.

The Hoffa administration has issued a new bulletin claiming that the UPS contract will protect members from harassment and forced, excessive overtime.

The truth is our Union went into contract negotiations with strong proposals to take on harassment and excessive overtime. But they got watered-down to nothing.

No Mandatory Financial Penalties for Harassment

Hoffa and Taylor admit that, “Monetary penalty was the number one member proposal” on harassment.

But the proposed contract has no financial penalties for harassment, intimidation, or retaliation when UPS is found guilty in the grievance procedure at a local or area panel. None. Zero. Zilch.

The only time that you can even possibly win a financial penalty is if you win a harassment or retaliation case at the National Grievance Panel. 

It takes months, if not years, for a harassed member to get a hearing at the national panel—and even if you win a case there, the company is still not required to pay a financial penalty.

This is an insult to drivers and inside workers alike who have put up with years of harassment and were promised real change in this contract. 

Excessive, Forced Overtime

Here are all the things that won’t change when it comes to excessive overtime if this contract is approved.

  1. Drivers will not automatically be opted-in to the 9.5 list. You still have to sign up for 9.5 and management can still pressure you to get off the 9.5 list.
  2. There is no tougher penalty for 9.5 violations. We were promised higher penalty pay. It’s not there.
  3. Penalty pay for hours worked over 9.5 will not be paid automatically into your next paycheck. You will still have to file a grievance every time management violates your 9.5 rights. Management can still stonewall those grievances, and settle for dimes on the dollar.
  4. Management does not have to readjust your load. More than penalty pay, drivers want our loads adjusted. Nothing in Hoffa’s 9.5 deal forces the company do that.
  5. Management can force drivers to work up to 70 hours a week. The new contract gives management the power in writing for the first time to force package drivers to work up to 70 hours a week.
