Why Didn’t the IBT Negotiate with YRC?

UPDATED December 19, 2013: Some 26,000 YRCW Teamsters are voting on a five-year contract extension with new concessions, and yet the leadership of their union never negotiated with the corporation. What’s wrong with this picture?

At the meeting of local officials held on December 6, IBT Freight Director Tyson Johnson was asked this question directly. His answer was that since he had heard loud and clear that the members didn’t want more concessions, he refused to bargain with the company. So, instead he sat for days with the company negotiators, but didn’t bargain on behalf of the members.

Then the Hoffa administration simply mailed the company’s proposal to the members, as a kind of, “accept it or watch your job disappear” ultimatum. What kind of leadership is that? None at all.

The union leadership could have told YRCW that they would negotiate at the same time that YRCW negotiated with their lenders, and so the union would have some leverage over the outcome. Not to ask members to first give concessions, then hope for the best from the bankers.

That’s why so many YRC Teamsters are speaking out against the concessionary deal, and many local officers are refusing to endorse it as well.

The lack of leadership from the Hoffa administration goes much deeper. For the past 15 years they have done nothing to defend our union or to organize in freight, or in carhaul or other trucking fields. They don’t have a strategy and don’t understand Teamster power. They have not organized; they have not defended the national master contracts or the members’ pensions.

So now YRC Teamsters are left to fend for themselves. Shame on you, James Hoffa, Ken Hall, Tyson Johnson, and Gordon Sweeton.

Ballots have been mailed out to retired teamsters! Active seniority employees not on withdrawal from the union are the only ones whose votes should be counted! There are even casuals who haven't worked for YRC for over a year who received a ballot! I have even heard retired preston drivers get to vote! Even part-time casuals are being allowed to vote! Where are the union officials when all this is happening!

Holland Voters were asked to refrain from voting if they were going to vote NO! Then YRC wonders why employees think the voting process is rigged! Just remember though, if the union officials are going to let us fend for ourselves "Let's All Stick Together!" The Teamsters have fought long and hard with scare tactics in the past and have prevailed! Let's stay strong and gain back what we've lost and deserve! Nobody has our backs but ourselves! With a total of 26,000 employees we can make this work for all of us!

If there are copies of envelopes and ballots mailed to such persons, and/or a copy of a letter to retirees urging them to vote or threatening their pension, get them to us right away and they will go to our attorney immediately. My voting ballot came from Teamsters National Freight. You say this reflects illegal subversion but who actually mails these ballots out. Is it the Union or YRC? IF it's the UNION mailing these out wouldn't they know who is a seniority employee verse retired or a casual. I can't imagine the Union just getting a list of names from YRC and not making sure the information is correct! And yes, I personally know a retired YRC employee who did receive a ballot so I know they were mailed out to retirees. I also personally know a casual who hasn't worked for the company for well over a year who received a ballot. Who should retirees report this to for verification so this can be corrected!

It is wrong for the Teamster Administration ( Hoffa's Team ) to be representing the Teamster's when they are part owner of the YRCW. So it's a Conflict of Interest, they try to represent the Union the IBT, because in reality they do now have the Teamster Members wholeheartedly ! So it's hard to trust someone who is only looking out for themselves ! Hoffa and his team of administration needs to be Elected out of office.

The line we got from the Local "leader" was the Union refused to reopen the contract. If this proposal, that the Union has submitted for ratification, is not reopening the contract? Then what the hell do they call it?

Hoffa and Hall want to ride the fence so, whatever the outcome is, they can shrug their shoulders, and say,  "We didn't endorse it or reject it, the members voted for it, don't blame us. Not getting the wage increase in 2014, getting stuck with an attendance policy that can get Teamsters suspended or fired for actions they were protected on before, pension freeze, carving out non=CDL dockworkers, clericals and maintenance workers at a new lower tier; all of this is not concessionary and doesn't reopen the contract? WTF!  

In the Local 251 hall, where soon to be ex-S/T Joe Bairos chaired our freight non-contract meeting on Sunday, there are portraits of Hoffa, Jr. and Ken Hall sandwiching a large smiling, portrait of Jimmy Hoffa, Sr, How ironic that around 50 years after Hoffa, Sr. inked the first NMFA, we're witnessing its last gasp.

YRC members need to fight back against another round of lies by the union. If you don't stand up now it might be too late. Remember this when Hoffa aks for your vote next election.

The Union officials are sending voting ballets out to people who are retired with a note that says if you dont vote YES your pension will be affected! They even sent ballets out to casuals who haven't worked at YRC for well over a year! One senior retiree posted that the nurse at his retirement home had to fill out his ballot form! This does not represent a fair vote! This vote is regarding give backs to the seniority employees! Retired employees are not giving anything back! Retired Employees will still receive their pension regardless if the vote is NO or Yes, as it comes from Central States not YRC! YRC went 18 months without contributing anything and now is only contributing 25%. You are still receiving your full pension and regardless of the vote it will still continue! I have a question regarding the number of votes mailed out? If this vote is based on 26,000 active employees, BUT retired and past casuals are receiving ballets, does something not add up here! SO,HOW MANY VOTES WERE ACTUALLY MAILED OUT? This vote is so unfair and rigged it's not funny!

Thanks to the site administrator for injecting rationale and reason into this story. OK brethren, you have your call! If you have solid evidence to support these claims of vote fraud, please bring them forth right away. It's important that you do so. 

On the other hand, if this is a bad joke, stop it now! There is no place in this situation for such kindergarten behavior.

This shouldn't be a cat and mouse game as to did Retired Teamsters and Casuals receive ballots or not.The UNION should have checked into this when the first suspicion arrived! The Union should KNOW EXACTLY TO THE T as too how many ballots were mailed out and to WHO! How hard could this be unless the UNION OFICIALS could care less! There are many other post on this site from terminals from all over different states who know of people who are retired or casuals that HAVE received a voting ballot!! Retired Teamsters have nothing to do with the give back of our paycheck, our pension feeze, attendance policy, etc..   Why would they vote on something that does not pertain to them anymore!!  This is just a way for more YES votes to come in. The UNION needs to hang on to all of the ballots after the count just in case a recount is needed!! Why not just have the UNION post a list of the names of  who actually was mailed out a ballot. That would clear this topic up so we can get of this subject!! 

Hoffa and Hall have shirked their responsibility once again. They ride the fence, so they can deny any responsibility on the outcome of this YRC concessionary proposal. The worst part of the YRC proposal is carving out a lower wage tier for non-CDL dockworkers, clericals, etc. On that issue alone, I am voting no.

This is supposed to be a union of all the members. An injury to one is an injury to all.

I still have not received my ballot. I will be calling my local tomorrow. If you have not gotten your ballot you are not getting it unless you call and ask for it. 

I am a shop steward and I am the managers #1 target. I have helped another employee get his job back. I have helped and educated my fellow teamster employees from being taken advantage of and played by our managers. I consistently prove my managers wrong and call them out when they play their games. Now I am being disciplined for petty stuff for a bolt being on the ground they say was by me even though they saw me cleaning before I left and for not working fast enough even though there is no performance clause. I do my job the best I can under the work rules I have to work under. I don't really care what other employees do nor am I a rat, but I don't BS with others about non work or non union related issues, I don't kick my feet up on the bosses desk and BS with her for 45 min a day, and I certainly don't have a tv that I set up to watch on football Sundays. Is this a form of union busting? Or maybe just a personal vendetta against me? Employees can only be as good as their managers allow them to be. Managers need to be held accountable for their actions just like we are. Favoritism, dishonesty, and harassment should be dischargible offenses for management just like it is for us. Managers should be held to a higher standard.

P.S. the lunchroom lawyer is a nickname given to me by my managers.

I am at a loss as to why the IBT has not uttered one single word regarding this MOU. I am under this proposal, allowing my fellow Teamster drivers to vote to deny me a pay increase until 2019. They may feel this is acceptable, but I hope they realize that subbing out some of our work is problematic. The thing that really gets me hot is the fact that management is not taking any NEW concessions. Granted, they would be under the same concessions under the existing MOU, but I don't see anything new in the way of concessions while we are expected to bear the brunt of reduced vacation, no pay increases etc.... All I hear is that managment will be subject to the same restrictions under the current MOU. They are not apparently giveing up anything more. That flys in the face of equality. That is why I am voting no, no, no, and no to this current proposal.

I hope you have - a plan "B".... This MOU is a discrace and will never get through. The Teamsters in this country have had enough bull shit shoved down their throats and watching you and your cronies get rich $$$ while they get the shaft. This will stop as this sad proposal you and the IBT have put on the table will fail. VOTE NO.

Hoffa and his "under the desk" buddy Hall are jokes allright..Very BAD jokes. I wonder if the boys at UPS Parcel will vote them back in ? I'm sure they will, Brown is the ONLY thing Fat Boy cares about, he gave up on Freight and Tank Haul a long time ago...Of course, he screwed UPS Freight quite well too.....$15.00 an hour line haul drivers ? What are these morons thinking ? Oh well got to keep those dues rolling in to protect THEIR JOBS...The new Teamster magazine just came out...Nice to see those 9 school bus drivers in no where Iowa organized.. I'm sure that will save us..

Anyone read the NFMA Article 6 Section 2 Extra Contract Agreements (page 35).

It reads:

(a) The Employer agrees not to enter into any agreement or contract with its employees, individually or collectively, which in any way conflicts with the terms and provisions of this Agreement. Any such agreement shall be null and void.

(b) Every profit-sharing plan, condition, or incentive plan of any type, whether or not it alters or amends the economic conditions contained in this Agreement, must be negotiated and agreed to by TNFINC prior to implementation.

IBT is saying that they did not negotiate with YRCW on this MOU. So that would mean that sub-section (b) would void out this MOU. Not to mention sub-section (a). Nothing can be ratified that the IBT did not negotiate. Remember we pay them to work for us. Correct me if I am wrong.

A retired teamster and now company employee in dispatch in Tracy CA received a ballot. I'm unsure if he voted but he has told some drivers he got a ballot. A dock worker who quit has gotten one too. I'm waiting to see the evidence.

So how is it that retirees, past employees get ballots and some current employees get 2 ballots but I still don't have one? How many times do I need to call my local? Something's not right :/

I've asked twice now on YRCs driveontogether site why, even though the lenders say they want agreements PAST the current contract, YRC wants to change the current contract instead of ammending an extension. No answer,guess they don't want to talk about it. Look at it,there are quite a few non-answers there,some have nothing at all to do with the question asked!

I finally received my ballot on dec 24th. But I didn't just receive one I got 2 delivered on the same day. Hmmm. One was post stamped and the other one wasn't. And what's this I hear about the company saying we can call in and change our vote if we already voted and change our mind? Can they do that? I smell corruption. 

YEARS ago, I worked as a casual for YRC/Roadway in the old , long closed Adelanto Break Bulk. Just as I "made it " onto the list, the terminal (as did Yellow/Barstow) shut down. It's now YEARS later and while still an active Teamster long in Tank Haul, why in heck did I get a ballot to vote on a proposal for a company that I have'nt worked for in years ? No matter, I'll still check any box NO and mail it back. This smells to high heaven as they say. But, then I'm not surprised. We are getting sold down the proverbial river in Tank Haul too..
